Financial Misappropriation Of Estate
We acted for a client after his mother had died. He had a fair idea of how much money his mother had accumulated in savings during her lifetime and as she was cautious about spending money, our client expected much of her savings to remain intact. Our client was shocked and upset to learn that his mother’s savings had in fact been depleted and there was nothing left at all.
Jordans Solicitors expert lost inheritance claims solicitors investigated the situation for our client and we identified from his mother’s bank accounts that regular cash withdrawals had been made weekly from the account. The amount of money withdrawn did not fit with his mother’s lifestyle and spending habits and we were able to establish a pattern of misappropriation of the money from her bank account over several years.
We were able to assist our client to show that another relative had been stealing from his mother and, through negotiations, we were able to achieve restoration of the estate by the repaying of most of the stolen money so that our client, and the other beneficiaries did not completely lose their inheritance.
This case highlighted the fact that even those closest to us who we may trust implicitly can abuse our trust especially where finances are concerned. In this case, what started out as a small abuse of trust quickly escalated into a full-scale theft which had gotten out of hand with the perpetrator being unable to stop themselves.
